As per the agreement, the contractor is not entitled for any payment for extra items, if the work has been executed by him without obtaining the written instructions from the engineer in charge. The instructions from any officer of the rank higher or lower are not sufficient. Oral instruction has no value. However, the remedy is available under contract act, but not under the agreement.
